Introduction

Welcome to LoadStop’s Privacy Policy. LoadStop provides a platform to transforms and automate trucking operations for driver and driverless fleets.

The Privacy Policy explains how LoadStop may collect, use, disclose, and secure information we obtain through the “Service.” The terms (“LoadStop,” “we,” and “us” or “our”) include LoadStop, Inc. and our affiliates and subsidiaries. This Privacy Policy is incorporated by reference into the LoadStop Terms and Conditions. Any capitalized terms used and not defined in this Privacy Policy shall have the meaning given to them in the Terms of Use.

Protecting your privacy is really important to us. Accordingly, we’re providing this Privacy Policy to explain our practices regarding the collection, use and disclosure of information that we receive when you use our Services (as defined in our Terms of Service). This Privacy Policy applies only to those websites, services and applications included within “Services” and doesn’t apply to any third-party websites, services or applications, even if they are accessible through our Services or the practices of companies that we don’t own or control or people we don’t manage. Also, please note that, unless we define a term in this Privacy Policy, all capitalized words used in this Privacy Policy have the same meanings as in our Terms of Service.

Types of information we may collect

The types of information we may collect or that you, your employer or other users of the Platform (collectively, “Users”) may provide when you or other Users:

access or use the LoadStop platform and/or mobile application(s) (individually and collectively, the “Platform”); and/or visit the website (www.Loadstop.com) (the “Website”). Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Privacy Policy only applies to information we collect through the Platform, and in email, text, or other electronic communications sent through or in connection with the Platform, and/or through the Website. This Privacy Policy DOES NOT apply to information that you provide to or is collected by any third party (see “Third-Party Information Collection”). These third parties have their own privacy policies, which we encourage you to read before providing information to them.

LoadStop operates the Platform to provide real-time visibility and predictive analytics and insights to enable companies (including shippers, carriers, drivers and brokers) in the shipping industry to:

LoadStop provides an integrated platform to automate end-to-end trucking operations for any size fleet using cloud, machine learning, data and telemetric devices. We collect information from and about Users of our Platform and visitors to our Website:

  • Directly from you or other Users when you or other Users provide it to us.
  • Automatically when you use the Platform and/or visit our Website.
  • Information Directly Provided by Users.

 

There are various areas within the Platform and/or the Website where you or other Users may directly provide information that personally identifies you (“personal information”).

This personal information may include: your name, postal address, email address, telephone number, mobile telephone number, or any other identifier by which you may be contacted online or offline; your user name, password or other credentials you use to access and use the Platform; and your work title, department information, role, status (e.g. on duty, driving, off duty), hours of service, and other information related to your work or employer.

content, communications and other information you provide when you use the Platform, including when you provide updates on a load, rate or review a shipping or warehouse facility and its amenities and message or communicate with others within the Platform or via in app notifications, text messages, emails or otherwise;

content, communications and other information that other people provide when they use the Platform, including information about you, such as when they send a message to you or respond to one of your posts in the Platform;

content, communications and other information that you provide to receive customer support; and requests or recommendations about the Platform.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

 

Automatic Information Collection & Tracking

When you download, access, and/or use the Platform, or when you visit the Website, the Platform or the Website may use technology to automatically collect information and data as detailed below.

Usage Details. LoadStop may automatically collect certain details of your access to and use of the Platform and/or the Website, including location data, traffic data, logs, and other communication data and the resources that you access and use on or through the Platform or the Website and how you use them.

Device information. We may collect information about the device with which you connect to the Platform and/or the Website and internet connection, including the device’s hardware model, operating system version, unique device identifiers, IP address, browser type, mobile network information, and telephone number.

Stored Information and Files. The Platform also may access metadata and other information associated with other files stored on your device or other systems. This may include, for example, ERP/TMS system and version, WMS system and version, OAS system and version, load creation data, pallet data, SKU management/order details, load status information, stop-level business hours, user groups, access management rules, notification rules, and email addresses and mobile telephone numbers to which notifications are to be sent.

Location Information. The Platform collects real-time information about the location of your device, including your actual location as determined by GPS signals sent by your mobile device or other technologies to determine location, some of which may be made available through third-party licensors.

The technologies we use for automatic information collection may include:

  • Cookies (or mobile cookies). A cookie is a small file placed on your device. It may be possible to refuse to accept cookies by activating the appropriate setting on your device. However, if you select this setting you may be unable to access certain parts of our Platform and/or Website.
  • Web Beacons. Pages of our Platform and/or Website, and our emails, may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages, or opened an email, and for other related Platform and/or Website statistics (for example, to help us improve and analyze the use of our Platform). It may be possible to refuse to accept web beacons by activating the appropriate setting on your device. However, selection of this setting may disable access to certain parts of the Platform and/or Website.
  • JavaScript Snippets. Our Platform uses JavaScript snippets to collect performance and usage information for analytics.
  • Mobile Background Service. A background service performs an operation that isn’t directly noticed by the user. Our mobile apps, upon consent from the user, track the user’s location in the background and send this information to the Platform server for processing the location of loads.
  • Third-Party Information Collection.

 

When you use the Platform, the Website, or the content in the Platform or on the Website, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:

  • The carrier company for which you work or by which you are engaged.
  • The shipper(s) or brokers of loads you carry.
  • Third-party technology or service providers for carriers, brokers and/or shippers.
  • Third-parties that provide support or services for the Platform and/or Website.
  • Advertisers, ad networks, and ad servers.
  • Analytics companies.
  • Your mobile device manufacturer.
  • Your mobile service provider.

 

These third parties may use tracking technologies to collect information about you when you use the Platform and/or the Website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. How We use Your Information

We use the information that we collect about you or that you or other Users provide to us, including personal information, to:

Make the Platform, the Website, and the content in the Platform or on the Website available to you, your employer or the other Users, which features include providing:

Load tracking including real-time tracking, arrival times predictions and communication tools to allow participants in the trucking and/or shipping industry (e.g. shippers, brokers, carriers and drivers) to communicate about loads;

Load planning including departure time recommendations and appointment scheduling for pick-up and delivery;

Visualizations and analysis tools to identify trends in the supply chain and measure impact in real-time and over time;

Ratings and reviews of shipping or warehouse facilities and amenities;

Community and private networks for participants in the trucking and/shipping industry to communicate and collaborate;

Status updates as to vehicle or vessel availability; and Tools to invite others to join the Platform.

Carry out our customer’s and our respective obligations and enforce our rights arising from agreements we enter into with our customers, including for billing and collection.

Respond to, or follow up on, your comments and questions, and otherwise provide customer service.

Ensure the functionality and security of our products and services, including the Website and Platform.

Provide you with any other information, products, or services that you request from us.

Notify you when Platform updates are available and of changes to any products or services we offer or provide through it.

Give you notices about your account or subscriptions, including expiration or renewal notices.

Track Platform usage and performance to better serve our customers and improve user experience.

Fulfill any other purpose for which you provide it. In addition, we anonymize and/or anonymize and aggregate data that we collect about you or that you or other Users provide to us to prepare reports, studies, analyses; maintain and improve the performance or functionality of the Platform and/or Website; demonstrate the effectiveness of the Platform, and develop new features, products, and other work product.

The usage information we collect helps us to improve our Platform and to deliver a better and more personalized experience by enabling us to:

Monitor usage patterns. Store information about your preferences, allowing us to customize our Platform according to your individual settings.

Recognize you when you use the Platform. We use device and location information we collect to track loads through the Platform and to create the anonymized and/or aggregated data described above.

Some features of the Platform may enable participants in the shipping and/or trucking industry and/or other companies with which we work to communicate and share data, including shippers, carriers, third-party logistic providers, system integrators and device manufacturers. In order for us make these features available within the Platform, it may be necessary for us to share your personal information with these parties. These parties are not allowed to use personally identifiable information except for the purpose of making such features available through the Platform. If you do not want your personal information to be shared, you can choose to not provide your personal information in the Platform, disable features of the Platform that automatically collects your personal information (e.g. disable location access from your mobile device for the Platform) or not use the Platform.

LoadStop may disclose aggregated information about our Users, and information that does not identify any individual or device, without restriction.

In addition, we may disclose personal information that we collect or that you provide:

To our subsidiaries and affiliates. To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

To licensees of our Platform pursuant to agreements with each such licensee. To shippers, carriers, brokers and other participants in the shipping and/or trucking industry to provide the Platform to our licensees.

To a buyer or other successor in the event of a merger, divestiture, restricting, reorganization, dissolution, or other sale or transfer of some or all of LoadStop’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by LoadStop about Platform users and/or Website visitors is among the assets transferred.

To fulfill the purpose for which you provide it. For any other purpose disclosed by us when you provide the information. With your consent.

To comply with any court order, law, or legal process, including to respond to government or regulatory requests or with law enforcement agencies or for an investigation related to public safety.

To enforce our rights arising from any contracts entered into between you or your company and us, including agreements for subscriptions to the Platform, and for billing and collection.

If we believe disclosure is necessary or appropriate to protect our rights, property, or safety of LoadStop, our customers, or others or to enable us to take precautions against liability.

 

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.

Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Platform and/or the Website may then be inaccessible or not function properly.

Location Information. You can choose whether or not to allow the Platform to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the Platform may then be inaccessible or not function properly.

Promotion by the Company. If you do not want us to use your email address to promote our own or third parties’ products or services, you can opt-out by sending an email to [email protected].

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (”NAI”) on the NAI’s website.

 

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Platform or of the Website, like message boards. The information you share in public areas may be viewed by any user of the Platform or visitor to the Website.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Platform or our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

 

Changes To Our Privacy Policy

We may update our Privacy Policy from time to time. If we make material changes to how we treat personal information, we will post the new Privacy Policy on this page with a notice that the Privacy Policy has been updated.

The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address and/or mobile phone number for you and for periodically visiting this Privacy Policy to check for any changes.
